Oregon DOJ clears Klamath County Sheriff’s deputy of criminal conduct

Dear Mr. Henderson:
On July 26, 2023, the Criminal Justice Division received your letter asking for our assistance in reviewing a conflict case alleging Klamath County Sergeant Ryan Kaber committed an assault while utilizing his canine partner in apprehending a suspect in a felony Attempt to Elude in a Vehicle.
During the course of our criminal investigation, we reviewed the original complaint and associated materials, including police reports, CAD reports, photographs, body camera video, emails, training logs, and sheriff's office policies. A special agent was assigned to the matter, and interviewed multiple witnesses, as well as Sergeant Kaber. We also consulted with a use of force expert specializing in canine and canine handler training and deployment. Based upon our review, we have concluded that there is insufficient evidence to prove beyond a reasonable doubt that Sergeant Kaber engaged in criminal conduct.
Because the scope of our investigation was limited to whether Sergeant Kaber committed a crime, we did not separately inquire into, and express no opinion on, whether Sergeant Kaber's conduct violated any civil, regulatory, or employment prohibitions.
