Second victim’s family files lawsuit against day care in violation of state laws

LINCOLN CITY, Ore. — A second 4-year-old girl and her mother are suing a Lincoln City day care for $3.5 million claiming the center failed to protect their child from another 4-year-old.

The suits, which don’t identify the girl or her parents, follow $8.1 million in lawsuits filed in April against the center by another girl and her mother.

The Child Care Division of the Oregon Employment Department investigated and found in January that Samaritan Early Learning Center was in violation of a state rule that requires children be within sight and sound of caregivers.
